{"id":3798,"date":"2024-07-04T06:52:42","date_gmt":"2024-07-04T06:52:42","guid":{"rendered":"https:\/\/thepolicetoday.com\/?p=3798"},"modified":"2024-07-04T09:34:19","modified_gmt":"2024-07-04T09:34:19","slug":"the-police-powers-restrictions","status":"publish","type":"post","link":"https:\/\/thepolicetoday.com\/?p=3798","title":{"rendered":"The Police Powers &#038; Restrictions-Displaying notice of arrested personal and In case of offences punishable with imprisonment below 3 years and, know a lot more"},"content":{"rendered":"<p><span style=\"color: #808080;\"><strong>THE POLICE TODAY\/<span style=\"color: #333399;\">NEWS<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #ff9900;\"><strong>Haridwar<\/strong><\/span>:<\/p>\n<p><em><strong><span style=\"color: #333399;\">The Police Powers &amp; Restrictions<\/span><\/strong><\/em><\/p>\n<p><span style=\"color: #ff9900;\"><strong>1.Displaying notice of arrested persons<\/strong><\/span><br \/>\nIn order to prevent the misuse of<br \/>\nprovisions related to arrest by Police,<br \/>\nthe BNSS (Cl. 37\/B) has introduced<br \/>\nadditional obligation on the State<br \/>\nGovernment to designate a Police<br \/>\nOfficer who would be responsible for<br \/>\nmaintaining information regarding<br \/>\nall arrests and arrestees. The Clause<br \/>\nalso requires such information to be<br \/>\ndisplayed prominently in every Police<br \/>\nStation and at District Hqrs.<br \/>\n<span style=\"color: #ff9900;\"><strong>2. In case of offences punishable with <\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>imprisonment below 3 years and<\/strong><\/span> where<br \/>\nthe accused is infirm or above 60 years<br \/>\nof age, a police officer cannot arrest the<br \/>\nperson without prior permission of an<br \/>\nofficer not below the rank of Deputy<br \/>\nSuperintendent of Police (Cl. 35\/7).<br \/>\n<span style=\"color: #ff9900;\"><strong>3. The category of persons who<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>could be informed regarding arrest<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>of the arrestee has been expanded<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>to include \u2018any other person\u2019, apart<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>from the existing provisions related<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>to informing any relative or a friend.<\/strong><\/span><br \/>\nAn entry of the fact as to who has been<br \/>\ninformed of the arrest shall be made in<br \/>\na book to be kept in the Police Station<br \/>\nin such form as the State Government<br \/>\nmay provide (Cl. 48\/3).<br \/>\n<span style=\"color: #ff9900;\"><strong>4. Provision has also been made<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>in the BNSS to enable the medical<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>practitioner conducting the medical<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>examination of an arrested person<\/strong><\/span>, to<br \/>\nconduct one more examination if such<br \/>\npractitioner deems it fit (Cl. 53).<br \/>\n<span style=\"color: #ff9900;\"><strong>5. Vide Cl. 58 of BNSS, an arrestee<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>may be produced before a magistrate<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>within the first 24 hours of arrest,<\/strong><\/span><br \/>\neven if such magistrate does not have<br \/>\njurisdiction.<br \/>\n<span style=\"color: #ff9900;\"><strong>6. Persons bound to conform to<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>lawful directions of Police: This is a<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>new insertion as CI.172 in Chapter XII<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>on &#8216;Preventive Action of the Police&#8217;.<\/strong> <\/span>It<br \/>\nprovides that persons must conform<br \/>\nto directions of the police, which are<br \/>\nissued in the course of preventing the<br \/>\ncommission of a cognizable offence.<br \/>\nA Police officer may detain or remove<br \/>\nany person resisting, refusing, ignoring<br \/>\nor disregarding to conform to any<br \/>\ndirection given by him for fulfilment<br \/>\nof any duty of a Police officer under<br \/>\nChapter XII on \u2018Preventive action of<br \/>\nthe Police\u2019 and may either take such<br \/>\nperson before a Magistrate or, in petty<br \/>\ncases, release him as soon as possible<br \/>\nwithin a period of twenty-four hours.<br \/>\n<span style=\"color: #ff9900;\"><strong>7. Protection against Prosecution<\/strong><\/span><br \/>\n<span style=\"color: #ff9900;\"><strong>for acts done under ss.148, 149 and<\/strong><\/span><br \/>\n<strong><span style=\"color: #ff9900;\">150<\/span>: <\/strong>Unlawful assembly is dispersed,<br \/>\nunder the CrPC, by the police under<br \/>\ndirections of an Executive Magistrate or officer in charge of a police station.<\/p>\n<p>For any dereliction in carrying out of<br \/>\nthese duties, police officers cannot be<br \/>\nprosecuted without sanction of the<br \/>\ngovernment. This essentially provides<br \/>\na layer of immunity to the officers.<\/p>\n<p>8.
