The Police Powers & Restrictions<\/span><\/strong><\/em><\/p>\n

1.Displaying notice of arrested persons<\/strong><\/span>
\nIn order to prevent the misuse of
\nprovisions related to arrest by Police,
\nthe BNSS (Cl. 37\/B) has introduced
\nadditional obligation on the State
\nGovernment to designate a Police
\nOfficer who would be responsible for
\nmaintaining information regarding
\nall arrests and arrestees. The Clause
\nalso requires such information to be
\ndisplayed prominently in every Police
\nStation and at District Hqrs.
\n2. In case of offences punishable with <\/strong><\/span>
\nimprisonment below 3 years and<\/strong><\/span> where
\nthe accused is infirm or above 60 years
\nof age, a police officer cannot arrest the
\nperson without prior permission of an
\nofficer not below the rank of Deputy
\nSuperintendent of Police (Cl. 35\/7).
\n3. The category of persons who<\/strong><\/span>
\ncould be informed regarding arrest<\/strong><\/span>
\nof the arrestee has been expanded<\/strong><\/span>
\nto include \u2018any other person\u2019, apart<\/strong><\/span>
\nfrom the existing provisions related<\/strong><\/span>
\nto informing any relative or a friend.<\/strong><\/span>
\nAn entry of the fact as to who has been
\ninformed of the arrest shall be made in
\na book to be kept in the Police Station
\nin such form as the State Government
\nmay provide (Cl. 48\/3).
\n4. Provision has also been made<\/strong><\/span>
\nin the BNSS to enable the medical<\/strong><\/span>
\npractitioner conducting the medical<\/strong><\/span>
\nexamination of an arrested person<\/strong><\/span>, to
\nconduct one more examination if such
\npractitioner deems it fit (Cl. 53).
\n5. Vide Cl. 58 of BNSS, an arrestee<\/strong><\/span>
\nmay be produced before a magistrate<\/strong><\/span>
\nwithin the first 24 hours of arrest,<\/strong><\/span>
\neven if such magistrate does not have
\njurisdiction.
\n6. Persons bound to conform to<\/strong><\/span>
\nlawful directions of Police: This is a<\/strong><\/span>
\nnew insertion as CI.172 in Chapter XII<\/strong><\/span>
\non ‘Preventive Action of the Police’.<\/strong> <\/span>It
\nprovides that persons must conform
\nto directions of the police, which are
\nissued in the course of preventing the
\ncommission of a cognizable offence.
\nA Police officer may detain or remove
\nany person resisting, refusing, ignoring
\nor disregarding to conform to any
\ndirection given by him for fulfilment
\nof any duty of a Police officer under
\nChapter XII on \u2018Preventive action of
\nthe Police\u2019 and may either take such
\nperson before a Magistrate or, in petty
\ncases, release him as soon as possible
\nwithin a period of twenty-four hours.
\n7. Protection against Prosecution<\/strong><\/span>
\nfor acts done under ss.148, 149 and<\/strong><\/span>
\n150<\/span>: <\/strong>Unlawful assembly is dispersed,
\nunder the CrPC, by the police under
\ndirections of an Executive Magistrate or officer in charge of a police station.<\/p>\n

For any dereliction in carrying out of
\nthese duties, police officers cannot be
\nprosecuted without sanction of the
\ngovernment. This essentially provides
\na layer of immunity to the officers.<\/p>\n
